Fifteen-Passenger Vans May Roll When Fully Loaded

FROM THE WEBMD ARCHIVES

Popular 15-passenger vans that were used to transport college athletes and nursing home residents have a deadly tendency to roll over when full.

The National Highway Traffic Safety Administration (NHTSA), has done an analysis that shows that large vehicles carrying 10 or more passengers have a “rollover rate in single-vehicle crashes that is almost three times that of lightly loaded vehicles.”

NHTSA says that this is because the extra load, especially if it’s more than five people, shifts center of gravity to the rear and up, making the van more susceptible to rolling.

Rae Tyson, NHTSA spokesperson, tells WebMD that while there is nothing intrinsically wrong with the vehicle it does handle differently than a passenger vehicle.

NHTSA and its parent agency, U.S. Department of Transportation are not currently recommending any modifications for the estimated 400,000 15-passenger vans that are on the road.

These vans come with the following:

Chevrolet Express 3500

GMC Savana G3500

Dodge Ram Van/Wagon A3500

Ford Econoline E350

Ford Club Wagon E350

GMC Rally/Vandura G3500

NHTSA recommends that experienced drivers drive these vans. Although drivers don’t need to hold a commercial license to operate these vans, they should be capable of keeping the vehicle under control with full loads. Federal officials also insist that passengers wear seat belts.

Tyson says that 80% of rollover victims died last year because they were not wearing their belts.

General Motors sold approximately 18,000 of these 15-seaters last fiscal year. General Motors spokesperson Mike Morrissey says that many of the buyers are budget-minded groups like churches and universities. Morrissey told WebMD that GM is open to safety improvements beyond what is required by the government, so long as it is affordable.

Morrissey says that while these vehicles can be safely operated, they are only safe when it is driven in a safe manner.

Clarence Ditlow is the director of the Center for Auto Safety in Washington. However, he thinks otherwise. WebMD is told by Ditlow that NHTSA surveys show that 15-passenger vans roll six times as often as a passenger vehicle.

The more severe the crash is, the more likely it is that the passenger will be ejected from their vehicle and suffer fatal injuries. The problem is that you have a vehicle that was not designed to transport passengers. … “Probably what’s going be happening is there will very large judgments against manufacturers,” Ditlow states.

He suggested that the roof be strengthened to make it less likely to fall during a roll, and that laminated safety glass be added to the side windows to reduce the chance of them shattering on impact. This would run around $200 per vehicle, according to Ditlow.

He adds, “Frankly speaking, if your van is full loaded, you might want to wait until the next van.”

Ditlow also stated that the van’s seat belts can be difficult to use.

Morrissey states that people get a false sense security when they are in large vehicles, but not if they aren’t buckled up.

Six high-profile incidents involving university athletes prompted the scrutiny of big van safety. In the mishaps, five students died and many were injured.

One instance was when the assistant coach from DePaul University in Chicago drove the women’s track team to Indianapolis. The car suddenly hit a patch on ice and rolled on January 22, 2000. Three minor injuries were sustained and one person was severely injured. All were able to recover. According to reports, the van was being driven at a speed well below the limit.

“We try and have all our children wear seat belts. That’s the responsibility of the coaches… but you don’t see what is going on in their back,” Pat Murphy (assistant athletic director for business, DePaul) tells WebMD.

Wednesday’s focus shifts to rollover hazards for cars, trucks and pickup trucks. NHTSA wants to determine if the current standard for measuring “top heaviness” is still valid. The two-day session will be attended by both industry and consumer representatives.

Auto Accidents

Every year, thousands of people are killed and injured in motor vehicle accidents. They are the number one cause of death among those aged below thirty-four.

Many victims or their families can face devastating medical bills or lost income. This can only be achieved through a personal injuries lawsuit with the help of an automobile collision lawyer.

Over 43,300 people were killed in accidents on the highways nationwide last year. This equates to more than 115 deaths per day. These accidents cost over $150 billion annually. Statistics show that you are statistically more likely to sustain personal injuries from an auto accident than any other. It is important to know how to protect yourself and your legal rights.

You should get medical attention immediately if you have suffered injuries. If you delay treatment, the defendant might argue that your injury was not caused by his negligence driving. Instead, it may have been something that happened between the accident and the visit to the doctor.

Drunk driving accidents

Over 17,000 Americans are killed each year in drunken driving accidents. A total of 500,000 people are also injured every year by drunk driving accidents. This equates to one drunk driving injury for every four minutes and one automobile accident-related death. It is important that DUI (driving under influence) does not refer to alcohol. However, it could also mean that the driver was under the influence or marijuana or cocaine. A driver could also be held responsible for not following the warning labels on prescription medication. Drunk driving accidents refer to operating an automobile under the influence all types of intoxicants. Many people drive drunk despite knowing that they can avoid drunk driving accidents.

Drivers who drive while impaired often fail to exercise reasonable care. Drivers who are caught driving under the influence are usually found guilty of drunk driving accidents. A drunk driver is often liable for any injuries or damages caused by drunk driving accidents. This compensation usually includes medical care, lost wages past and future, and emotional anguish. Punitive damages are available for drunk driving accidents. These damages are intended to punish and discourage such conduct.

Pedestrian Accidents

Pedestrian injuries account for approximately 11% of all -related causalities. Nearly 5,000 pedestrians are killed each year in pedestrian accidents. Another 70,000 are injured. Statistics show that pedestrians are more at risk of injury and death than any other non-occupant group involved in motor vehicle accidents.

Half of all pedestrian crashes happen between 3:00 and 4:00 PM. Children and seniors are most at risk in these types accidents. To avoid being hurt while crossing streets or roads, pedestrians should take extra precautions.

There are many reasons pedestrian accidents can occur. Most pedestrian accidents are caused by negligent drivers , not pedestrians. This negligence could include:

* Speeding by the driver

* Driver not paying attention when driving

* Driver is preoccupied

* Driver is under the influence alcohol or drugs

Motorcycle accidents

Motorcycle accident account for a significant portion of all accidents-related deaths each year, approximately 8%, despite only 2% of drivers on the roads being motorcyclists. Nearly 80% of motorcycle crashes result in death, compared to 20% for motor vehicle accidents. Recent statistics show that a motorcyclist is 16x more likely than an auto occupant to die in a motorcycle accident and 3x more likely to sustain injuries. This equates to more than 3,000 deaths and around 50,000 injuries each year from motorcycle accidents in America. Most motorcycle collisions are not caused by motorcyclists. This is a worrying fact. Most motorcycle accidents are not caused by negligent drivers, unsafe roadway conditions or manufacturing defects.

It is important to follow certain steps if you are in an motorbike accident. If you have been injured, seek immediate medical attention. Police must be summoned to the scene of the accident and create a report. It is vital to exchange information with other involved parties, including phone numbers, addresses and license plates numbers. Photograph the accident scene if possible. Remember that any statements you make after the accident could be used against your in a future case so give only accurate facts. You should always obtain a copy the police report. These reports are usually available within 10 days of the incident. Your lawyer can help you if the report doesn’t accurately reflect what you remember.

Truck Accidents

Every year, more than 5,000 people are killed and 133,000 are injured in truck accidents. Truck accidents are often serious because a commercial truck (large freight carrier, eighteen-wheeler) weighs 25 times more than an average car. Truck accidents pose unique risks that can be made worse by the truck contents. If hazardous, flammable or toxic substances are found in a truck, secondary injuries can occur, including burns and respiratory injury. Truck drivers are statistically more safe than automobile drivers. However, many commercial drivers still drive unsafely.

Trucking accidents can be caused by many factors. Unfortunately, the trucking industry doesn’t always promote safe operation. Some drivers are not given the training they need to operate such a large truck. Others are forced to work extra hours to keep their eyes open. Sometimes, other motorists may be negligent and cause a truck-truck collision. Truck accidents are most often caused by:

*Driver is under the influence or drugs

*The driver is speeding

*Driver fatigue

*The driver is tailgating

*Failing to load the truck

*Faulty maintenance

*Violations safety regulations

Tractor Trailer Accident Lawyer

Lawyers for tractor trailer accident victims often represent people who have been seriously injured or even killed by the negligence of a tractor truck driver.

Around 500,000 tractor-trailer trucks, or “semis”, are involved in traffic accidents each year in the United States. This results in around 5,000 deaths. One out of eight traffic deaths is actually caused by collisions with tractor trailers or large trucks.

It is not surprising that most deaths and injuries are caused by tractor trailers. These victims or their families must seek the help of a skilled tractor trailer accident lawyer to obtain the rightful compensation.

Federal law requires that tractor trailer operators and large truck drivers obtain a commercial driver’s license and submit to limited drug and alcohol testing. In a case involving tractor trailer accidents, lawyers for the plaintiff often request proof of such testing.

A tractor trailer accident lawsuit often focuses on truck driver fatigue.

New tractor trailer laws implemented by The U.S. Department of Transportation’s Federal Motor Carrier Safety Administration(FMCSA) in 2003 allow drivers to drive 11 hours after 10 consecutive hours off-duty. Drivers are not allowed to drive past the 14th hour, after having been on duty for 10 hours.

Similar to existing rules, tractor trailer drivers may not drive after being on-duty for 60 hours in a seven-consecutive-day period or 70 hours in an eight-consecutive-day period. Drivers who have taken at least 34 hours off-duty consecutively may restart the cycle.

A tractor trailer accident lawyer can often win a lawsuit on behalf of the victim or their / their survivors if they are able to show that such regulations were violated, or adhered to negligently.

Uber and Lyft

In the U.S., calling for an Uber/Lyft driver has become more popular. It’s convenient and easy and many city dwellers love having an alternative to the traditional taxi.

However, this industry is not without its dark sides. Uber was sued by a woman who claimed she was sexually assaulted and abused by her driver in April 2019. Police reported in May 2019 that Lyft driver had been accused of sexually assaulting two passengers at separate stops during the same trip.

Both companies have made steps to make their public statements, but it remains unclear what they will do about sexual harassment and assault.

Uber Drivers Assault and Abuse More Than 100 Victims

An CNN report published about a year ago showed that 103 Uber drivers, and 18 Lyft drivers were accused of sexual assault or abuse in the past four years. At least 31 drivers were convicted of related crimes that range from forcible touching and rape.

This data was not made public by ride-sharing companies. CNN investigators found this information after looking at police reports, court records and court databases for 20 cities in the United States. Uber acknowledged the problem. Uber introduced new safety features last year, including an in-app 911 button. Uber also promised to make driver screenings more rigorous, including an annual background check.

The Business Insider reported in June 2019 that Baltimore police were investigating claims that an Uber driver had raped a 25-year old passenger. The New York Times reported in May 2019 that an Uber driver from Pittsburgh was charged with kidnapping, false imprisonment and trying to lock two female passengers inside his vehicle.

A ride-share driver for Uber and Lyft, aged 34, was charged with rape. He was also suspected of having committed at least five sexual assaults as he drove for the companies.

It is not just riders that are at risk.

Drivers of Uber and Lyft also at risk for sexual Harassment or Assault

Bloomberg reported that a male Uber driver in Maine was frequently subject to sexual harassment by other passengers a few months back. She claimed she had to fight off one male passenger who tried to kiss her and grab her while she was driving. Another was in the front seat and began talking about “sexual stuff” until she dropped him at his home.

She reported that over 100 of the thousand rides she took for Uber and Lyft had resulted in inappropriate advances or uncomfortable encounters.

Since its creation in 2016, a private Facebook group for female drivers of ride-sharing vehicles has seen over 10,000 members. Drivers often share their stories of harassment and assault.

Both ride-sharing companies have pledged to make safety for passengers and drivers a top priority. However, currently drivers do not receive formal sexual harassment training, and there is little data available about the frequency of sexual harassment or assaults while riding on ridesharing platforms.
